The government has made a clear commitment to give “due consideration to the UN Convention of the Rights of the Child (UNCRC) when making new policy and legislation.” The government’s own impact assessment of the Bill falls short of this standard, by excluding cases relating to children under-16 and failing to take into account their unique rights under the UNCRC. The amendments advocate the right for all children under 18 to be provided access to civil legal aid and vulnerable young people up to 24 to have access to civil legal aid for their immigration claims.
