Section 55 of the Borders, Citizenship and Immigration Act 2009 places a duty on the Secretary of State – and thereby the UKBA – to promote the best interests of the child in immigration, asylum, nationality and customs functions. The accompanying statutory guidance emphasises the fact that children have the right to be consulted and to express views on matters concerning them.
